Terms of Service

1. Acceptance

By accessing the ServerSage website, customer portal, reseller portal or purchasing any Service, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must have legal capacity to contract and provide accurate registration information. Companies must be represented by authorised persons.

3. Services

ServerSage provides VPS, Dedicated Servers, Cloud Hosting, GPU Hosting, Backup, Disaster Recovery, Email Hosting, Managed Services, Professional Services and related cloud solutions. New services are also governed by these Terms unless stated otherwise.

4. Accounts

Customers are responsible for account security, passwords, MFA, authorised users and all activity performed through their accounts.

5. Orders & Provisioning

Orders may be placed online, by quotation, purchase order or email. Provisioning begins after payment, verification and, where applicable, KYC completion.

6. Customer Responsibilities

Customers remain responsible for applications, operating systems unless managed, licensing, compliance, customer data, passwords, backups, business continuity and lawful use of the Services.

7. Acceptable Use

Illegal activities, hacking, malware, phishing, spam, copyright infringement, crypto abuse, DDoS attacks, unlawful content and activities affecting platform stability are prohibited. ServerSage may immediately suspend offending services.

8. Billing

Services are generally prepaid. Fees, GST and taxes are payable as invoiced. Late payments may attract interest and suspension. Setup, migration and licence fees are generally non-refundable unless required by law.

9. SLA & Support

Availability targets are governed by the SLA. Planned maintenance, emergency maintenance and force majeure are excluded. Critical infrastructure incidents are supported 24×7.

10. Customer Data

Customers retain ownership of their data. ServerSage processes data only to provide services, comply with law and maintain security. Customers are responsible for lawful processing of their own customer data.

11. Backup

Unless Backup as a Service or Managed Backup is purchased, customers are solely responsible for backups. RAID, replication, HA and snapshots are not backups.

12. Security

Security is a shared responsibility. ServerSage secures infrastructure while customers secure operating systems, applications, users and business data unless Managed Services are purchased.

13. Intellectual Property

ServerSage retains ownership of its software, portals, documentation and trademarks. Customers retain ownership of their applications, websites, databases and content.

14. Privacy & KYC

ServerSage may collect information necessary to provide services, comply with law and verify identity. PAN, GST and Aadhaar-based eKYC (with consent and where legally permitted) may be requested.

15. Suspension & Termination

Services may be suspended for non-payment, abuse, security threats, failed KYC or legal requirements. Customers should retrieve all data before termination.

16. Disclaimer

Services are provided 'AS IS' and 'AS AVAILABLE'. No guarantee is given for uninterrupted operation or business outcomes except as expressly stated in the SLA.

17. Limitation of Liability

To the fullest extent permitted by law, ServerSage's aggregate liability is limited to the recurring fees paid for the affected service during the preceding three months. Indirect, consequential and loss of profit damages are excluded.

18. Governing Law

These Terms are governed by the laws of India. Disputes shall first be resolved amicably, failing which they shall be referred to arbitration in Mumbai under the Arbitration and Conciliation Act, 1996. Mumbai courts have jurisdiction where court intervention is required.

19. Changes

ServerSage may update these Terms. Continued use of the Services after publication constitutes acceptance of the revised Terms.

20. Related Policies

These Terms should be read together with the Privacy Policy, Acceptable Use Policy, SLA, Refund Policy, Cookie Policy, KYC Policy, Data Retention Policy and other published ServerSage policies.
