Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") forms an integral part of the Terms of Service of ServerSage CloudTech Pvt. Ltd. ("ServerSage", "Company", "we", "our", or "us").

The purpose of this Policy is to ensure that all customers, resellers, users, and authorized representatives use ServerSage's infrastructure responsibly, securely, and in compliance with applicable laws.

This Policy applies to all services provided by ServerSage including, but not limited to:

  • Virtual Private Servers (VPS)
  • Dedicated Servers
  • GPU Servers
  • Cloud Hosting
  • Business Email Hosting
  • Tally on Cloud
  • Backup as a Service
  • Disaster Recovery
  • Managed Services
  • Colocation
  • Domain Registration
  • SSL Certificates
  • Microsoft 365
  • Google Workspace
  • Remote Desktop Hosting
  • Infrastructure Monitoring
  • APIs
  • Customer Portal
  • Reseller Portal

Violation of this Policy may result in service suspension, termination, legal action, or reporting to appropriate authorities.

2. Customer Responsibilities

Customers are responsible for all activities performed using their account, servers, virtual machines, applications, APIs, storage, domains, and network resources.

Customers must:

  • Keep account credentials secure.
  • Use strong passwords and Multi-Factor Authentication (MFA) where available.
  • Keep operating systems and applications updated.
  • Maintain appropriate backups unless managed backup services are purchased.
  • Monitor systems for unauthorized access.
  • Promptly report security incidents to ServerSage.
  • Ensure that authorized users comply with this Policy.

Customers remain responsible for actions performed by employees, contractors, agents, and any person using their credentials or systems.

3. Compliance with Laws

Customers shall comply with all applicable laws and regulations, including but not limited to:

  • Information Technology Act, 2000
  • Digital Personal Data Protection Act, 2023
  • Copyright Act, 1957
  • Indian Penal Code (or its successor legislation)
  • Consumer Protection Act, 2019
  • GST laws
  • CERT-In Directions
  • Export control and sanctions laws, where applicable

Customers are solely responsible for ensuring that their use of the Services complies with the laws applicable to their business and jurisdictions.

4. Prohibited Activities

The following activities are strictly prohibited on ServerSage infrastructure:

Illegal Activities

Customers shall not use the Services for:

  • Fraud
  • Identity theft
  • Money laundering
  • Terrorist activities
  • Human trafficking
  • Child exploitation
  • Illegal gambling
  • Distribution of prohibited content
  • Financial scams
  • Pyramid schemes
  • Ponzi schemes
  • Counterfeit products
  • Sale of illegal goods or services

Malware and Malicious Software

Customers shall not:

  • Host malware
  • Host ransomware
  • Host spyware
  • Host trojans
  • Host worms
  • Distribute malicious scripts
  • Create botnets
  • Operate command-and-control servers
  • Distribute viruses

Hacking Activities

Customers shall not:

  • Perform unauthorized penetration testing
  • Scan third-party networks without authorization
  • Attempt privilege escalation on systems not owned or managed by them
  • Intercept network traffic unlawfully
  • Use ServerSage infrastructure for credential theft
  • Conduct brute-force attacks
  • Exploit software vulnerabilities belonging to third parties

Phishing and Fraud

Customers may not use the Services to:

  • Host phishing websites
  • Create fake login pages
  • Collect credentials fraudulently
  • Impersonate banks
  • Impersonate government authorities
  • Conduct Business Email Compromise (BEC) attacks
  • Distribute fake invoices
  • Conduct online scams

Spam and Email Abuse

Customers shall not:

  • Send unsolicited bulk email
  • Operate spam campaigns
  • Purchase email lists for mass mailing
  • Send deceptive marketing emails
  • Relay spam through mail servers
  • Abuse SMTP services

Email services must comply with applicable anti-spam laws and industry best practices.

Denial-of-Service (DoS/DDoS)

Customers shall not:

  • Launch DoS attacks
  • Launch DDoS attacks
  • Amplification attacks
  • Reflection attacks
  • Stress testing of third-party systems
  • Traffic flooding

Cryptocurrency Mining

Customers may not use infrastructure for:

  • Cryptocurrency mining
  • Blockchain validation
  • Mining pools
  • Proof-of-Work mining
  • Unauthorized GPU mining

Approved GPU servers may be used for AI, machine learning, rendering, scientific computing, and other legitimate compute-intensive workloads in accordance with agreed service specifications.

Copyright and Intellectual Property

Customers shall not:

  • Distribute pirated software
  • Share copyrighted movies without authorization
  • Share copyrighted music unlawfully
  • Host illegal streaming services
  • Distribute cracked software
  • Circumvent copyright protection mechanisms

Customers are responsible for ensuring that all content hosted using the Services complies with applicable intellectual property laws.

Adult Content

Customers shall not host or distribute content that:

  • Violates applicable law
  • Exploits minors
  • Contains non-consensual explicit material
  • Promotes human trafficking
  • Involves illegal sexual content

Any report involving child sexual abuse material (CSAM) or other illegal content may be reported to the appropriate authorities.

Resource Abuse

Customers shall not intentionally consume excessive shared resources in a manner that materially affects other customers or the stability of the platform. Examples include sustained CPU abuse, excessive disk I/O, abusive network traffic, or activities designed to degrade shared infrastructure.

5. Enforcement

Where ServerSage reasonably believes that this Policy has been violated, it may take one or more of the following actions:

  • Issue a warning
  • Request corrective action
  • Suspend affected services
  • Restrict access to specific resources
  • Remove or disable prohibited content where appropriate
  • Terminate services for serious or repeated violations
  • Cooperate with lawful requests from competent authorities

Where practical, customers will be given an opportunity to address non-critical issues before suspension. Immediate action may be taken where necessary to protect infrastructure, other customers, or comply with legal obligations.

6. Reporting Abuse

Suspected abuse, security incidents, or violations of this Policy may be reported to:

Please include sufficient information to enable investigation, such as affected IP addresses, timestamps, log excerpts, URLs, or other relevant evidence.

7. Changes to this Policy

ServerSage may update this Acceptable Use Policy from time to time to reflect changes in technology, legal requirements, security practices, or business operations.

Updated versions will be published on the ServerSage website with a revised effective date.

9. Governing Law

This Policy shall be governed by the laws of India. Any disputes arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, unless otherwise required by applicable law.
